KVKK Information Text

This "Information Notice" is provided by ShibariTurkey in accordance with Article 10 of the Law No. 6698 on the Protection of Personal Data ("KVKK") to inform and enlighten you about the processing of your personal data, the transfer of your processed personal data, the methods and legal basis for collecting your personal data, and your other rights listed in Article 11 of the KVKK. We would like to state that we show the utmost sensitivity to the confidentiality and security of all personal data you provide to us and that all necessary technical and administrative security measures have been taken to protect this data.

Data Controller Status

In accordance with the KVKK (Turkish Personal Data Protection Law), ShibariTurkey, as the Data Controller, hereby declares that we will record, store, process, classify, update, and disclose and transfer your personal data to third parties in accordance with the law and principles of fairness, within the scope of the purposes stated below, and to the extent permitted by the KVKK and related legislation, in accordance with the purpose for which they are processed.

The purpose of processing your personal data.

Your personal data is processed by ShibariTurkey in accordance with the fundamental principles stipulated in the Personal Data Protection Law (KVKK) and related legislation, based on your explicit consent and/or other circumstances foreseen in Article 5/2 of the KVKK, primarily the legal regulations we are subject to, in order to enable you to benefit from the services we offer. Considering the services provided by ShibariTurkey, your personal data is processed in the foreign language training process, in processes related to our business relationships, in technical processes, in order to meet the requests of third parties, and in the continuation of the Company's commercial activities. It is stored securely in physical and electronic environments for an appropriate period of time in accordance with the purpose of processing. In this respect, ShibariTurkey acts in compliance with all its obligations stipulated in the legal legislation, primarily the KVKK.

What is the Method and Legal Basis for Collecting Your Personal Data?

Your personal data is collected by ShibariTurkey through the following different channels for the purpose of conducting our operations.

1. Personal data provided directly to ShibariTurkey by you: All information and documents you submit to us;

2. Personal data collected about you from third parties: Information and documents collected from institutions and organizations that ShibariTurkey collaborates with and/or its customers, as well as from official institutions;

3. Personal data we collect through cookies and similar technologies.

Your personal data may be collected by ShibariTurkey.com and/or partner institutions' websites and other similar channels through automated or non-automated means, in written, verbal or electronic form.

In this context, your personal data may be processed and transferred with your explicit consent in accordance with the principles stipulated in Article 4/2 of the KVKK (Law on Protection of Personal Data), or without your explicit consent if the conditions stipulated in Articles 5/2 and 6/3 are met.

Transfer of Your Personal Data

Within the scope of the processing purposes listed above, your personal data may be shared with our group companies, direct/indirect business partners, customers, suppliers, business partners, independent audit companies within the framework of legal limitations, or public institutions or organizations authorized to request this data due to a legal obligation, and other relevant institutions and organizations, in accordance with the conditions and purposes of personal data processing regulated in Articles 8 and 9 of the KVKK (Personal Data Protection Law), based on your explicit consent or in other cases stipulated in Article 5/2 of the KVKK, primarily the applicable legislation, and limited to the purposes of our activities.

Transfer of Personal Data Abroad

Your personal data may be transferred by ShibariTurkey in accordance with Article 4/2 of the KVKK (Law on Protection of Personal Data), with your explicit consent, or without your explicit consent if the conditions stipulated in Articles 5/2 and 6/3 exist, and only to individuals and entities located in foreign countries declared by the Personal Data Protection Board ("Board") as having adequate protection, in accordance with the rules set forth in Article 8 of the KVKK; and for countries where adequate protection is determined and declared to be lacking, only in cases where the data controllers in Türkiye and the relevant foreign country have provided a written guarantee of adequate protection and the Board's permission has been obtained.

Your Rights According to Article 11 of the KVKK (Personal Data Protection Law)

First and foremost, the accuracy and up-to-date nature of the personal data we process and/or store is crucial for ShibariTurkey's business operations. Therefore, we kindly request that you inform us as soon as possible if any changes occur to your personal data.

On the other hand, as the owner of personal data, your rights under Article 11 of the KVKK (Law on Protection of Personal Data), subject to the exceptions stipulated in Article 28, are as follows:

1. To find out whether your personal data is being processed,

2. Requesting information regarding the processing of your personal data.,

3. To learn the purpose for which your personal data is processed and whether it is used appropriately for that purpose.,

4. To know the third parties to whom your personal data is transferred, whether domestically or internationally.,

5. The right to request correction of your personal data if it has been processed incompletely or incorrectly.,

6. Requesting the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the KVKK (Law on Protection of Personal Data).,

7. In cases where you request the correction of your personal data if it is incomplete or inaccurate, and the deletion or destruction of your personal data, you may request that these actions be notified to third parties to whom your personal data has been transferred.,

8. You have the right to object if a result is obtained against you solely through the analysis of your personal data by automated systems.,

9. You have the right to claim compensation for damages if you suffer harm as a result of the unlawful processing of your personal data.

In this context, when exercising your rights, you must submit your requests to ShibariTurkey in writing or through the methods specified by the Personal Data Protection Board (KVKK). Since the Personal Data Protection Board has not yet determined any other method, written submission is currently required. To do this, you can apply in person with a written petition containing your explanation of the right you wish to exercise, along with documents identifying your identity, or you can submit your request to ShibariTurkey via a notary public or with a secure electronic signature.

As a data subject, you irrevocably declare, accept, and undertake that you have read and accepted the Personal Data Protection Policy Statement above before conducting any transactions on the ShibariTurkey website, and that by conducting transactions on the website, you are deemed to have consented to the processing and sharing of your personal data.
