KVKK Information Text

With this “Information Text”, we, as ShibariTurkey, would like to inform and enlighten you regarding personal data processing, transfer of your processed personal data, collection methods of your personal data and your other rights listed in Article 11 of the KVKK, with legal reasons, in accordance with Article 10 of the Law on the Protection of Personal Data No. 6698 (“KVKK”). We would like to state that we show utmost sensitivity regarding the confidentiality and security of all personal data you provide to us and that all necessary technical and administrative security measures have been taken to protect this data.

Data Controller Title

In accordance with the KVKK, we, as ShibariTurkey, as the Data Controller, hereby declare that we will record, store, process, classify, update your personal data in accordance with the law and the rules of integrity, within the scope of the purposes specified below, and disclose and transfer them to third parties in accordance with the purpose for which they are processed, to the extent and in cases permitted by the legislation related to the KVKK.

Purpose of Processing Your Personal Data

Your personal data is processed in accordance with the basic principles regulated in the KVKK and relevant legislation in order for you to benefit from the services we offer as ShibariTurkey, in accordance with your explicit consent and/or other cases stipulated in Article 5/2 of the KVKK, primarily the legal legislation we are subject to. Considering the services provided by ShibariTurkey, your personal data is processed in the foreign language education process, in processes related to our business relations, in technical processes, in order to meet the demands of third parties, and in the continuation of the Company's commercial activities. It is stored securely in physical and electronic environments for an appropriate period of time in accordance with the purpose of processing. In this way, ShibariTurkey acts in accordance with its obligations stipulated in all legal legislation, primarily the KVKK.

What is the Collection Method and Legal Reason for Your Personal Data?

As ShibariTurkey, your personal data is collected through different channels specified below for the purpose of carrying out our activities.

1. Personal data provided directly to ShibariTurkey by you: All information and documents you send to us;

2. Personal data collected about you from third parties: Information and documents collected from institutions and organizations that ShibariTurkey cooperates with and/or from customers and official institutions;

3. Personal data we collect through cookies and similar technologies.

Your personal data may be collected automatically or non-automatically, in written, verbal or electronic form, through ShibariTurkey.com and/or contracted institution websites and other similar channels.

In this context, your personal data can be processed and transferred by obtaining your explicit consent in the light of the principles set forth in Article 4/2 of the KVKK or without your explicit consent in the presence of the situations set forth in Article 5/2 and Article 6/3.

Transfer of Your Personal Data

Within the scope of the processing purposes listed above, your personal data obtained may be shared with our group companies, direct/indirect business partners, customers with whom we have agreements and provide services due to our activities, suppliers, business partners, independent audit companies within the framework of legal restrictions or public institutions or organizations authorized to request such data due to a legal obligation, including but not limited to other relevant institutions and organizations, based on your explicit consent or in other cases stipulated in Article 5/2 of the KVKK, primarily in the applicable legislation, and in accordance with the personal data processing conditions and purposes stipulated in Article 8 and Article 9 of the KVKK, limited to the purposes of activity.

Transfer of Personal Data Abroad

Your personal data may be transferred by ShibariTurkey only to persons and organizations resident in foreign countries with sufficient protection, as determined by the Personal Data Protection Board (“Board”), in accordance with the regulation stipulated in Article 4/2 of the KVKK, with your explicit consent or without your explicit consent in the event of the situations stipulated in Article 5/2 and Article 6/3, and in accordance with the rules stipulated in Article 8 of the KVKK, only to persons and organizations resident in these countries, and for countries where it is determined and declared that there is no sufficient protection, limited to cases where the data controllers in Turkey and the relevant foreign country undertake in writing to provide sufficient protection and the Board’s permission can be obtained.

Your Rights According to Article 11 of KVKK

First of all, it is important that your personal data that we process and/or store is accurate and up-to-date due to the nature of the commercial activity we carry out as ShibariTurkey. Accordingly, if there is any change in your personal data, we kindly ask you to inform us as soon as possible.

On the other hand, as the owner of personal data, your rights under Article 11 of the KVKK are as follows, provided that the situations stipulated in the “Exceptions” provision in Article 28 of the KVKK are reserved:

1. Learning whether your personal data is being processed,

2. Requesting information about your personal data if it has been processed,

3. Learning the purpose of processing your personal data and whether they are used in accordance with their purpose,

4. Knowing the third parties to whom your personal data is transferred, either domestically or abroad,

5. Request correction of your personal data if it is processed incompletely or incorrectly,

6. Request the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the KVKK,

7. If you request that your personal data be corrected if it is incomplete or incorrect, and that your personal data be deleted or destroyed, request that these transactions be notified to third parties to whom your personal data has been transferred,

8. Objection in case a result occurs against you as a result of your personal data being analyzed exclusively by automatic systems,

9. If you suffer damage due to the unlawful processing of your personal data, you have the right to demand compensation for the damage.

In this context, when exercising your rights, you must submit your requests to ShibariTurkey “in writing” or via the methods specified by KVKK. Since the Personal Data Protection Board has not yet determined another method, it is required that your requests are submitted in writing at this stage. For this, you can apply in person with your written petition containing your explanations regarding the right you want to exercise, along with documents that establish your identity, while completing your application, or you can submit this request to ShibariTurkey via a notary public or with a secure electronic signature.

As the personal data owner, it is understood that you have irrevocably declared, accepted and undertaken that you have read and accepted the Personal Data Protection Policy Statement above before making a transaction on the ShibariTurkey website, and that by making a transaction on the website and web page, you will be deemed to have consented to the processing and sharing of your personal data.
